General License Terms

The Developer Kernel (DK) product is licensed on the basis of one license per each user. The DK is typically used for application development, but a license is required for each user regardless of the nature, extent, or duration of the use. The user of the DK product under each license must be registered to the license in the TatukGIS system. It is the responsibility of each customer to ensure that each DK licensed user is accurately registered in the TatukGIS system.

The DK licensing is generally free of deployment royalty fees or run-time costs, with limited exceptions:

1. The use of the DK to develop a server application requires the payment of a DK Server Deployment Royalty for each production server to which the DK functionality is deployed (including each server computer in a multiple server configuration). A server application is one in which requests from networked or web connected computers (or user stations) result in the DK code being executed on a remote computer (the server). For more guidance on what is and what is not a DK server situation, refer to Knowledge Base item KB10742.
2. The DK may not be used to develop an application which is similar or competitive to the TatukGIS Editor product if the application will be licensed to the general GIS user market. Essentially, this forbids use of the DK for any purpose that is detrimental to sales of the TatukGIS Editor. (This restriction is not applicable for the great majority of DK customers who use the DK to create applications which are not marketed to the general GIS user market or that are highly specialized for a particular industry niche.)
3. The DK may not be used to create any product which can be used for development purposes, such as a component for use by other application developers or any GIS application which exposes the DK API, such as via scripting.

The DK license maintenance is provided on an annual subscription basis. Each license purchase includes maintenance for the first 12 months. The maintenance includes download access and user rights to each downloaded upgrade/update version of the licensed product, log-in access to the DK user forums, and TatukGIS e-mail technical support. Renewal of the license maintenance for each additional 12 month period is optional and presently costs 40% of the price of a new license.
